TERMS & CONDITIONS
DEFINITIONS
Parties: The parties entering into this agreement are defined as the "Customer" and "Corporate Air Travel Solutions L.L.C" (C.A.T.S). The Customer shall be the Individual, Customer or Entity requesting the charter service with C.A.T.S being the Air Carrier Company providing or brokering the charter service.
ACKNOWLEDGEMENT OF OPERATIONS
Customer hereby acknowledges that C.A.T.S in its capacity as an Air Carrier Company may also act as a broker to provide the charter service on the Customers behalf and, upon acceptance of the charter, the Customer will be advised of the Air Carrier Company that will be providing the service. The Customer further acknowledges that the Air Carrier Company and its flight crew providing the service will have full operational control of the flight and, will have sole responsibility, liability and control of all aspects of the aircraft charter services provided to the Customer, including without limitation, aircraft availability, the commencement and termination of the charter service, the operation, FAA regulation condition, safety of flight, Customer baggage and cargo handling, crew performance and catering services.
GENERAL
The charter quote provided by C.A.T.S is aircraft size specific (light, medium or large) but not "aircaft tail # specific". The quote is based upon aircraft and crew availability and is not confirmed until signed along with the terms & conditions and, a form of pre-payment and or payment gaurantee is secured.
All chartered flights will be deemed non-smoking. Pets may be allowed but must be contained in a pet carrier and specifically approved by C.A.T.S or the Air Carrier providing the service prior to the flight. Passenger provided oxygen whether medical or otherwise is not permitted on the flight. Additional scheduled and unscheduled flight stops may be necessary for fuel, weather, customs or other operational reasons beyond Air Carrier control.
PAYMENT TERMS
All quotes are at a fixed price and valid for (48) hours from issuance. Quotes issued with less than (48) hours prior to departure are given subject to aircraft availability and may be withdrawn or changed without notice. Prices quoted include fuel surcharges, and landing fees. Prices quoted do not include incidental charges, including without limitation, catering, ground transportation, Federal Excise Tax, segment charges, unscheduled overnight fees, additional flight time due to diversion for weather or other reasons beyond the control of C.A.T.S or the Air Carrier providing the service, de-ice charges or hanger charges due to inclement weather, other special services or Customer requests. Quotes will only be valid subject to receipt of pre-payment or payment gaurantee. Pre-payment shall be in the form of a credit card, bank wire or certified check. If pre-payment by credit card is selected it will be subject to an additional 4% administration fee. Payment gaurantee shall be in the form of a credit card (10) day authorization. Lack of pre-payment or payment gaurantee will constitute cancellation of the flight and cancellation terms delineated herein shall apply. If the flight is secured by payment gaurantee, full payment of all charges including incidental charges is due no later than (10) days from the date of the flight or, the credit card used as payment gaurantee will be charged including a 4% administration fee.
CANCELLATION POLICY
One-way reservations including multi-leg one ways, once confirmed and payment received, if cancelled will be subject to an immediate 100% cancellation charge. Round trip resevations cancelled less than (72) hours before departure will be charged the greater of 35% of the quoted price or $4,000 for light jets, $7,000 for mid size jets, $10,000 for large jets, plus any positioning or repositioning flight cost incurred, any hotel costs, flight planning costs or pre-paid international flight cost. Round trip reservations may not be cancelled after planned departure time and date. All flights reserved and cancelled during holidays (from two days prior to US national holidays and through two days after US national holidays) are subject to an immediate 100% cancellation charge.
PASSENGER IDENTIFICATION
Photo ID's are required by all passengers for all flights. For international flights (including Canada, Mexico and the Carribean) current passports and other correct documentation (as applicable) are required. Customer is liable for any fines, penalties or other costs arising from failure to provide a current passport and or incorrect documentation or non approval of passenger(s) checked against TSA no fly lists.
ITINERARY CHANGES
Flight schedules must be determined at time of confirmation. Itinerary changes are permitted subject to aircraft and flight crew availability and will include any applicable price adjustments. Acceptance of changes will be at the sole discretion of C.A.T.S or the Air Carrier providing the service. In the event changes are not accepted and the flight is cancelled by the Customer, all cancellation charges will apply as delineated herein. Notification of all requested changes and cancellations must be made in writing and sent by facsimile to 716-326-2179. Flight departure times may be subject to change by C.A.T.S or the Air Carrier providing the service for operational reasons.
RESPONSIBILITY AND PARTIAL COMPLETION OF FLIGHTS
C.A.T.S shall not be held liable for any injury, damage, loss, expense, special or consequential damages or other irregularity caused by the defect of any vehicle or conveyance, or the negligence of any other company or person engaged in conveying the Customer and or passengers or any arrangements for the reserved trip(s) or, by accident, delay, flight schedule, change, cancellation, sickness, weather, strikes, acts of war quarantine or any similar cause. C.A.T.S liability shall in any case be limited to the amount paid to us by the Customer and, any claim shall be adjudicated in and governed by the laws of the state of Ohio. C.A.T.S shall not be liable for additional expenses incurred for replacement transportation in the case of aircraft mechanical problems. In such cases C.A.T.S charges shall apply only to the portions of the flight completed. If a flight is unable to reach its destination due to weather, charges shall only apply to any destination reached and the return flight of the aircraft (with or without passengers) to its home base.
